Ras Bath Case: Referral to an Abolished Court Sparks Judicial Confusion
Bamako, December 16, 2025 - In the case of Mohamed Youssouf Bathily, known as Ras Bath, the Indictment Chamber did not order his release but instead referred his case to the Assize Court-a court that has been abolished in Mali, creating significant judicial confusion. Media sources indicate that the case will likely be transferred to the Anti-Cybercrime Unit for prosecution.
This incident underscores the dysfunctions within the Malian judicial system, especially in cases involving public figures critical of the regime.
On the positive side, it could accelerate reforms to clarify judicial procedures and strengthen the rule of law within the AES framework. However, independent analysts warn of the risks of politicized justice, which could prolong arbitrary detentions and invite human rights criticism during the transitional period.
