DRC Constitutional Court Rejects Former Justice Minister Constant Mutamba’s Petitions

Kinshasa, DRC - December 19, 2025 - The Constitutional Court of the Democratic Republic of the Congo on Friday dismissed two petitions filed by former Justice Minister Constant Mutamba, ruling them admissible but unfounded.

The court rejected Mutamba’s challenges against National Assembly resolutions that authorized his judicial investigation and prosecution, as well as his appeal of a pretrial ruling by the Court of Cassation. Judges found no serious constitutional violations in either case.

Mutamba had argued that the parliamentary resolutions violated procedural guarantees and separation of powers, and that the Cassation Court infringed on constitutional provisions regarding rule of law, equality before the law, fair trial rights, and judicial independence. All claims were dismissed on their merits.

This ruling follows the September 2, 2025, decision of the Court of Cassation, which sentenced Mutamba to three years of forced labor for embezzlement of $19 million in public funds. He was also barred from holding public office or standing for election for five years.
